Terms of Sale

1. Definitions

1.1 We, us, our means Nora Noelle Brown.
1.2 You and your means the purchaser of goods, services, digital products, or written, audio, or video content from Nora Noelle Brown.
1.3 These Terms constitute a contract between you and us.
1.4 “Lifetime Access” means ongoing access to a course for the duration that the program exists, not for your personal lifetime or for the lifetime of Nora Noelle Brown.
   1.4.1 You will continue to have access at no additional charge until the purchased offer is no longer offered.
   1.4.2 We will give at least 12 months’ notice before closing any program or community. Such closure does not affect our refund policy and does not entitle members to any form of refund.

2. Contract

2.1 When you purchase written, audio, or video content from us, we grant you a limited, revocable, non-exclusive, non-transferable license to listen to, download, or stream such content to your computer or device(s) solely for your personal, non-commercial use.

2.2 You agree not to copy, reproduce, distribute, modify, publicly perform, sell, transfer, or create derivative works from the content, except as expressly permitted under these Terms. Any breach of this clause may result in termination of your license without notice.

3. Payment

3.1 Instalment Plans
   You may request to pay by instalments. If we agree, you must pay all instalments on or before each due date.

3.2 Instalment Due Dates
   Each instalment is due 30 days after purchase and payment of the first instalment, and every 30 days thereafter until fully paid.

3.3 International Fees
   We are based in Portugal. If you are located outside Portugal, your bank or card provider may charge international transaction or currency conversion fees, which are beyond our control.

3.4 Pricing and VAT
   All goods and services are charged in the currency indicated at checkout. If you are located in Portugal or within the European Union, the listed price includes VAT, if applicable.

4. Warranty

4.1 We will repair or replace at our discretion any physical goods or services found to be physically defective within 12 months of purchase. This warranty does not apply to defects due to misuse, accidental damage, or negligence on your part.

5. EU Consumer Law & Limitation of Liability

5.1 Non-Excludable Rights
   Nothing in these Terms limits or restricts your right to make a claim if we fail to comply with non-excludable guarantees or statutory rights provided under applicable EU consumer protection laws.

5.2 Conformity Obligation
   Subject to clause 5.4 and to the extent permitted by EU law, we will use our best endeavors to ensure that products conform to their description. If any product is defective within the period mandated by EU law (commonly two years from delivery, unless otherwise specified by national legislation), you may request that the goods be repaired or replaced, provided the non-conformity is not “major” or “fundamental” under EU law.

5.3 No Indirect or Consequential Damages

  • Under no circumstances, including any act or omission on our part, will we be liable for indirect, incidental, special, or consequential damages or loss of profits arising from your use of, or inability to use, the products.
  • Exclusion of Implied Warranties
    We exclude all warranties, conditions, and terms implied by statute or common law, except where such exclusion is prohibited by EU law.
  • Limit on Liability
    We will not be liable for any claims or damages beyond what is required by law. This includes faulty design, negligent or misleading advice, or any indirect/special damages arising from use or misuse of the products.

5.4 Products Not for Personal, Domestic, or Household Use
   If the product is ordinarily not acquired for personal, domestic, or household use, we may, where legally permissible, limit our liability to:
   (a) The cost of replacing the goods or supplying equivalent goods;
   (b) The cost of repairing the goods; or
   (c) The cost of having the goods repaired or replaced.

5.5 Force Majeure
   We are not liable for any failure or delay in performance caused by events beyond our reasonable control (e.g., acts of God, war, strikes, labor disputes, shortages of materials, or other force majeure events).

5.6 Third-Party Components or Unauthorized Alterations
   We are not responsible for any loss resulting from errors or defects caused by third-party components, nor for faults arising from alterations or misuse not authorized by us.

6. Refunds & Exchanges

6.1 Voluntary Refunds

  • Right of Withdrawal (14-Day Cooling-Off)
    Under EU law, you have a 14-day period to cancel the purchase of digital content without giving a reason. To request a refund, email nora@noranoellebrown.com with your full name, registration email, and product details.
  • Immediate Download Exception
    By opting for immediate access and download, you expressly consent to early supply and acknowledge that you forfeit your right to withdraw once the download or streaming has begun.
  • Consequences
    • If you do not opt for immediate access, you have 14 days from the date of purchase to cancel and request a refund, provided you have not downloaded or used the digital product.
    • If you do opt for immediate access and confirm your consent to waive the withdrawal right, no refunds will be granted once the download or streaming has started.

(a) If you receive a refund, you must delete all copies of the product and associated materials from your devices and storage.
(b) Being removed or banned from any Facebook group or other community does not entitle you to a refund.

6.2 EU Consumer Protection Rights
You may be entitled to a refund under EU consumer protection laws if there is a substantial failure to meet acceptable standards. In such cases, you may request a replacement, repair, or refund, depending on the nature of the non-conformity.

6.3 Refund Processing
If you are entitled to a refund, it will be processed within 14 days of our confirmation that you qualify.

6.4 Return of Goods
If a physical return is required, you bear the cost of returning the goods unless such cost is considered significant under applicable law.

6.5 Currency
Refunds are issued in the same currency you used for payment. If you paid in a different currency, you are responsible for any exchange fees.

7. Privacy

You agree to our Privacy Policy, which can be found on our Website.

8. Trademarks

Trademarks used on the Website belong to their respective owners. You must not use any trademark displayed on the Website without express written permission from us or the relevant third-party owner.

9. Jurisdiction

9.1 These Terms are governed by and construed in accordance with the laws of Lisbon, Portugal. You irrevocably submit to the exclusive jurisdiction of the courts of Portugal.

9.2 If any provision in these Terms is found invalid or unenforceable by a court, the remainder will continue in full force and effect.

10. Events

10.1 Cancellation Policy
Tickets are non-refundable but fully transferable. To transfer a ticket, please email the new attendee’s full name and email address to nora@noranoellebrown.com at least 3 business days before the event.

10.2 Event Changes
We reserve the right to change the event details, including the location, with notice. If such a change occurs, we will make every effort to ensure an equivalent event is available within a reasonable distance of the original location.

10.3 Behavior
We may refuse entry or eject any person from an event for inappropriate behavior, as determined by our staff or agents.

10.4 Image Release
By registering for an event, you grant us permission to use photos/videos containing your image or likeness for promotional, educational, and/or research purposes, without remuneration. If you do not consent, email nora@noranoellebrown.com promptly.
